Our employment market is inundated with a mash-up of complex laws and employment awards across a myriad of acts.\r\n\r\nIt certainly comes as no surprise that many employers are facing immense pressure when dissecting and interpreting legislation. Given the potentially serious penalties of a breach, effective recruiters need to keep abreast of the latest changes.\r\n\r\nNot sure where to begin? Here are the seven-recruitment legislation acts that every recruitment professional should know:\r\n<h3><strong>1) Fair Work Australia Ombudsman<\/strong><\/h3>\r\nMostly governed by the <a href=\"https:\/\/www.legislation.gov.au\/Series\/C2009A00028\" target=\"_blank\" rel=\"noopener\">Fair Work Act 2009 (FWA)<\/a> and the <a href=\"https:\/\/www.legislation.gov.au\/Series\/F2009L02356\" target=\"_blank\" rel=\"noopener\">Fair Work Regulations 2009<\/a>, the Fair Work Ombudsman promotes a healthy workplace for employees, contractors, and employers alike, by providing information and advice on work rights and obligations.\r\n\r\nOverall, these Acts are substantial and legally complex, making it difficult for everyday employers to interpret. Failure to comply with the Fair Work Act can result in formidable damage to your business, and there are many such cases in the public domain of household names such as Coles, Woolworths, 7-Eleven, McDonalds, and other well-known recruitment agency brands.\r\n<h3><strong>2) Privacy Act<\/strong><\/h3>\r\nThe <a href=\"https:\/\/www.legislation.gov.au\/Series\/C2004A03712\" target=\"_blank\" rel=\"noopener\">Privacy Act 1988<\/a> is a law that oversees the regulation and handling of private and personal information about individuals \u2013 most commonly, individuals\u2019 names, signatures, addresses, contact numbers, dates of birth, medical records, bank account details, and commentary or opinion about a person.\r\n\r\nThe Privacy Act is a difficult legislation to monitor, given that it delves further into thirteen <a href=\"https:\/\/www.oaic.gov.au\/privacy-law\/privacy-act\/australian-privacy-principles\" target=\"_blank\" rel=\"noopener\">Australian Privacy Principles or APPs<\/a> and applies to APP entities (Australian and Norfolk Island Government Agencies).\r\n\r\nBreaches in privacy are covered under the <a href=\"https:\/\/www.oaic.gov.au\/privacy-law\/privacy-act\/notifiable-data-breaches-scheme\" target=\"_blank\" rel=\"noopener\">Notifiable Data Breaches<\/a> scheme, which is available for us by APP entities as well as individuals when the breach is assumed to cause serious harm to those affected.\r\n\r\nCurrently, breaches under the Privacy Act can incur a <a href=\"https:\/\/www.oaic.gov.au\/about-us\/our-regulatory-approach\/guide-to-privacy-regulatory-action\/chapter-6-civil-penalties\" target=\"_blank\" rel=\"noopener\">maximum fine of AUD 500,000<\/a>.\r\n<h3><strong>3) Criminal Code Act 1995<\/strong><\/h3>\r\nYou might think, \u201cWhy am I mentioning this specific piece of legislation?\u201d <a href=\"https:\/\/www.legislation.gov.au\/Details\/C2019C00043\" target=\"_blank\" rel=\"noopener\">The Criminal Code Act 1995 (CTH)<\/a> is the main piece of legislation relating to federal offences in Australia.\r\n\r\nThis act encompasses everything we do in everyday life - but as a recruiter, and dovetailing with the <a href=\"https:\/\/www.legislation.gov.au\/Series\/C2004A03712\" target=\"_blank\" rel=\"noopener\">Privacy Act 1988<\/a>, the serious threat to professional organisations is the escalation of cybercrime. If your organisation does not have a focus on this area, then I encourage you to do so immediately. Computer-related offences are a serious threat to any business, either from internal team members or cyber criminals around the world. A proactive approach should be adopted and maintained, including items such as security awareness training for your teams and a technology review of all of your systems and processes. Furthermore, ensuring the appropriate level of insurance specifically related to cyber security is a must-have!\r\n<h3><strong>4) Workplace Health, Safety Standards, and the Workplace Health and Safety Act<\/strong><\/h3>\r\nThe establishment of national policies focused on improving work H&amp;S and workers\u2019 compensation across Australia is led by <a href=\"https:\/\/www.safeworkaustralia.gov.au\/\" target=\"_blank\" rel=\"noopener\">Safe Work Australia<\/a>.\r\n\r\nBusinesses and employers are required, and have a legal responsibility, to implement and enforce H&amp;S practices accordingly, covering all employees, contractors, and even volunteers or visitors.\r\n\r\nWhile WHS may be seen as a nuisance and an expensive practice by some, the price of failing to comply with the legislation is even more costly and may include prosecution.\r\n\r\nIn Queensland alone, there are <a href=\"https:\/\/www.business.qld.gov.au\/running-business\/whs\/whs-laws\/penalties\" target=\"_blank\" rel=\"noopener\">four categories of offences<\/a>.\r\n\r\nWorkers Compensation is specific to each Australian state, therefore, there are several acts across all states, each with its own legislation, and I have provided below for ease of reference links to the relevant state-based acts. Supporting these are other legislative requirements, such as regulations, however, there are far too many to mention here.\r\n<ul>\r\n \t<li><strong>ACT<\/strong> - <a href=\"https:\/\/www.legislation.act.gov.au\/a\/1951-2\/\" target=\"_blank\" rel=\"noopener\">The Workers Compensation Act 1951<\/a><\/li>\r\n \t<li><strong>NSW<\/strong> \u2013 <a href=\"https:\/\/legislation.nsw.gov.au\/view\/html\/inforce\/current\/act-1998-086\" target=\"_blank\" rel=\"noopener\">Workplace Injury Management and Workers Compensation Act 1998<\/a><\/li>\r\n \t<li><strong>NT<\/strong> \u2013 <a href=\"https:\/\/legislation.nt.gov.au\/Legislation\/WORK-HEALTH-AND-SAFETY-NATIONAL-UNIFORM-LEGISLATION-ACT-2011\" target=\"_blank\" rel=\"noopener\">Work Health And Safety (National Uniform Legislation) Act 2011<\/a><\/li>\r\n \t<li><strong>QLD<\/strong> \u2013 <a href=\"https:\/\/www.legislation.qld.gov.au\/view\/pdf\/inforce\/current\/act-2003-027\" target=\"_blank\" rel=\"noopener\">Workers Compensation and Rehabilitation Act 2003<\/a><\/li>\r\n \t<li><strong>SA<\/strong> \u2013 <a href=\"https:\/\/www.legislation.sa.gov.au\/lz?path=%2Fc%2Fa%2Fworkcover%20corporation%20act%201994#:~:text=WorkCover%20Corporation%20Act%201994%20See%20Return%20to,Work%20Corporation%20of%20South%20Australia%20Act%201994\" target=\"_blank\" rel=\"noopener\">WorkCover Corporation Act 1994<\/a><\/li>\r\n \t<li><strong>TAS<\/strong> \u2013 <a href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/tas\/consol_act\/wraca1988400\/\" target=\"_blank\" rel=\"noopener\">Workers Rehabilitation and Compensation Act 1988<\/a><\/li>\r\n \t<li><strong>VIC<\/strong> \u2013 <a href=\"https:\/\/www.legislation.vic.gov.au\/in-force\/acts\/workers-compensation-act-1958\/160\" target=\"_blank\" rel=\"noopener\">Workers Compensation Act 1958<\/a><\/li>\r\n \t<li><strong>WA<\/strong> \u2013 <a href=\"https:\/\/www.legislation.wa.gov.au\/legislation\/statutes.nsf\/main_mrtitle_1090_homepage.html\" target=\"_blank\" rel=\"noopener\">Workers Compensation and Injury Management Act 1981<\/a><\/li>\r\n<\/ul>\r\n<h3><strong>5) STP \u2013 Single Touch Payroll<\/strong><\/h3>\r\n<span style=\"font-weight: 400;\">In July 2018, the <a href=\"https:\/\/www.ato.gov.au\/\" target=\"_blank\" rel=\"noopener\">ATO<\/a> implemented a change in reporting methods, requiring businesses with a minimum of 20 employees to report to the Commissioner on or before each payday using <a href=\"https:\/\/www.ato.gov.au\/business\/single-touch-payroll\/\" target=\"_blank\" rel=\"noopener\">Single Touch Payroll<\/a>.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Detailed information on tax and superannuation, payment of salary, wages, allowances, deductions, and such will now need to be provided directly from each business\u2019 payroll provider.<\/span>\r\n\r\nThe new STP scheme is a critical move to identifying superannuation non-compliance and will allow the Tax Office to implement penalties on employers who do not comply with their <a href=\"https:\/\/www.ato.gov.au\/Business\/Super-for-employers\/\" target=\"_blank\" rel=\"noopener\">superannuation obligations<\/a>.\r\n<h3><strong>6) Payroll Tax<\/strong><\/h3>\r\nPayroll Tax is a state tax that is calculated on wages, as you, an employer, pay to your employees or deemed employees.\r\n\r\n<a href=\"https:\/\/www.payrolltax.gov.au\/\" target=\"_blank\" rel=\"noopener\">Payroll Tax<\/a> is a self-assessing tax that requires employers to establish whether the level of their wages paid or payable requires them to register with the respective state government.
