{"id":5425,"date":"2018-02-26T09:36:41","date_gmt":"2018-02-26T09:36:41","guid":{"rendered":"https:\/\/www.bullhorn.com\/de\/?p=5425"},"modified":"2024-10-16T11:23:11","modified_gmt":"2024-10-16T11:23:11","slug":"dsgvo-gdpr-anforderungen-personalvermittler","status":"publish","type":"post","link":"https:\/\/www.bullhorn.com\/de\/blog\/dsgvo-gdpr-anforderungen-personalvermittler\/","title":{"rendered":"Was ist die DSGVO\/GDPR und was ist der Einfluss auf Personalvermittlungsagenturen?"},"content":{"rendered":"<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">GDPR stands for General Data Protection Regulation, but in many cases, great drama and panic would also apply to recruiters. <\/span><span style=\"vertical-align: inherit\">The German term for this is the General Data Protection Regulation (GDPR). <\/span><span style=\"vertical-align: inherit\">Nevertheless, the GDPR does not have to be a cause for concern for recruitment agencies. <\/span><span style=\"vertical-align: inherit\">If you are well informed and prepared for the GDPR, the new legislation can even bring about positive changes within your organization.<\/span><\/span><\/p>\n<h3><span style=\"font-weight: 400;color: #ff6600\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">What is the goal of the GDPR?<\/span><\/span><\/span><\/h3>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The General Data Protection Regulation (GDPR) is known for data protection, but actually includes human rights. <\/span><span style=\"vertical-align: inherit\">Data protection is part of human rights and the GDPR is the most up-to-date means of maintaining these human rights. <\/span><span style=\"vertical-align: inherit\">Since the introduction of previous regulations, the power imbalance in data control has seriously deteriorated. <\/span><span style=\"vertical-align: inherit\">Individuals have less and less control over who has their data. <\/span><span style=\"vertical-align: inherit\">The GDPR wants to change that.<\/span><\/span><\/p>\n<h3><span style=\"font-weight: 400;color: #ff6600\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Who needs to be GDPR compliant?<\/span><\/span><\/span><\/h3>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The GDPR is aimed at all organizations that process data on European residents, regardless of the location of the organization in the world. <\/span><span style=\"vertical-align: inherit\">Every organization in an EU member state is obliged to meet the requirements &#8211; if not, this can lead to insanely high fines.<\/span><\/span><\/p>\n<h3><span style=\"font-weight: 400;color: #ff6600\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The GDPR comes either way<\/span><\/span><\/span><\/h3>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">There is no point in just waiting and hoping that the GDPR will eventually expire. <\/span><span style=\"vertical-align: inherit\">This law has been around for a while, but as of May 25, 2018, it will be final. <\/span><span style=\"vertical-align: inherit\">The European Parliament has given organizations 2 years to prepare for implementation and that, according to Parliament, is more than enough time to prepare.<\/span><\/span><\/p>\n<h3><span style=\"font-weight: 400;color: #ff6600\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">What is the GDPR exactly?<\/span><\/span><\/span><\/h3>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The GDPR is intended for individuals and their rights; <\/span><span style=\"vertical-align: inherit\">more specifically, the right to have control over your own data. <\/span><span style=\"vertical-align: inherit\">These include the right to correct data, the right to delete data and many other data-based rights. <\/span><\/span><a href=\"https:\/\/www.bullhorn.com\/de\/blog\/2017\/11\/13\/welche-rechte-hat-ein-kandidat-laut-gdpr\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Read more about candidate rights here<\/span><\/span><\/a><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> .<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">A number of important rights that personnel service providers have to look out for are:<\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><b><\/b><span style=\"vertical-align: inherit\"><span style=\"font-weight: 400\"><span style=\"vertical-align: inherit\">Right of <\/span><\/span><span style=\"color: #ff6600\"><b><span style=\"vertical-align: inherit\">information of the<\/span><\/b><\/span><span style=\"font-weight: 400\"><span style=\"vertical-align: inherit\"> data subject <\/span><\/span><\/span><span style=\"font-weight: 400\"><span style=\"color: #ff6600\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">:<\/span><\/span><\/span><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> The data subject has the right to receive confirmation from a data controller that their data will be processed. <\/span><span style=\"vertical-align: inherit\">In this case, the recruitment agency must provide the following information: <\/span><\/span><br \/>\n<span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">&#8211; The processing <\/span><\/span><br \/>\n<span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">purposes <\/span><span style=\"vertical-align: inherit\">&#8211; <\/span><span style=\"vertical-align: inherit\">Which categories of personal data are processed <\/span><\/span><br \/>\n<span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">&#8211;
